Terms of Use

These Terms of Use (“ToU”) govern the use of the Hydra Suite software and services provided by Szalai Kevin EV (the “Provider”).

1. Scope

These ToU apply to the relationship between the Provider and the Customer regarding the Hydra PMS, Hydra POS and Hydra INV software and the related implementation, support and maintenance services. The individual contract is to be read together with this document; in case of conflict, the individual contract prevails.

2. Licence and use

The Provider grants a limited, non-exclusive, non-transferable right of use to the Customer within the limits of the ordered size-tier. Reverse-engineering, sub-licensing to third parties or reselling of the software is prohibited.

3. Regulatory compliance

Hydra Suite provides features that support Hungarian regulatory obligations (e.g. NAV Online Invoice, NTAK and VIZA data reporting). The Provider supplies these features and maintains them in line with the published specifications. However, correct configuration, accurate data entry, and the verification and submission of the Customer's own invoices, filings and reports remain the Customer's responsibility. The Customer is responsible for ensuring that their use of the software meets the legal obligations applicable to their own business.

4. Fees

The current prices on hydrasuite.hu/en/pricing are indicative; the final fee is set by the individual contract. Prices are in Hungarian forint (HUF); VAT is added as required by law. Invoicing is monthly, by bank transfer.

5. Availability and support

By default the Hydra Suite software runs on-premises and continues to operate without an internet connection. Business-hours email support is included in every tier; higher tiers receive priority response. Detailed response times are agreed in the individual contract.

6. Warranty disclaimer

The software is provided “as is” and “as available”. To the maximum extent permitted by Hungarian law, the Provider gives no warranty that the software will be uninterrupted or error-free, or that it is fit for a particular purpose beyond the features expressly described. Statutory rights that cannot be excluded under applicable law remain unaffected. The Customer is responsible for maintaining adequate backups and for testing the software for their intended use before relying on it.

7. Limitation of liability

To the extent permitted by Hungarian law, the Provider's aggregate liability is limited to the fees paid by the Customer for the software in the twelve (12) months preceding the event giving rise to the claim. The Provider is not liable for indirect or consequential damages — including lost profit, lost revenue, regulatory fines, or damage arising outside the scope of Hydra Suite (hardware faults, power or internet outages, third-party services, or incorrect data entry or configuration by the Customer). Nothing in these ToU excludes or limits liability that cannot be excluded under mandatory law, including liability for intentional or grossly negligent conduct or for harm to life, bodily integrity or health.

8. Termination

Either party may terminate the contract in writing with 30 days' notice. Fees due up to the termination date remain payable to the Provider. After termination the Customer may request export of their data in a machine-readable format.

9. Governing law

These ToU are governed by Hungarian law. In case of a dispute the parties will first attempt amicable resolution; failing that, the court at the Provider's registered office has exclusive jurisdiction.
